Bench Warrants in Robertson County
A bench warrant is court process tied to a missed appearance or another unmet court obligation. Local city materials use “FTA charge” and “warrant” language. An unpaid fine in a fine-only matter may lead to a capias pro fine, while a district criminal case may use a capias or another arrest process.
There is no single county workflow. Hearne, Franklin, each JP precinct, the County Court, and the 82nd District Court retain separate records. Ask the clerk which process was issued before relying on a payment screen or a sheriff listing.
Robertson County Bench Terms Need Care
The label tells the reader what to ask next. Texas court terms can describe different steps, so a phone answer should name the process and the case it belongs to.
- FTA
- Failure to appear or respond to a required setting or citation.
- Alias warrant
- A later process after an earlier notice or warrant did not result in compliance.
- Capias
- A writ directing an officer to bring a person before the issuing court.
- Capias pro fine
- Fine-enforcement process in a fine-only case after an unpaid judgment.
Ask whether the court requires an appearance, payment, approved plan, bond, or motion. Do not assume that two courts use the same label for the same step.
How a Bench Warrant Is Issued
A missed date does not tell a reader which process the judge entered. Hearne's courtesy sheet says failure to respond may lead to an FTA charge, collection fees, and a warrant. Franklin's court information page also warns that an FTA can result in a charge and warrant. The JP handout describes FTA/VPTA and failure-to-pay reporting.
Ask the clerk whether the court recorded an FTA, alias warrant, capias pro fine, or another order. Then ask for the next setting, balance, appearance rule, and written proof after the court acts. Do not infer that every late response creates the same warrant.
Hearne Calls Do Not Count as Appearance
Hearne Municipal Court's courtesy sheet states that calling does not constitute an appearance. It says extensions and payment plans must be approved in court on the appearance date, not arranged by phone or email. The sheet also describes an in-person process for a not-guilty plea.
That city rule is specific to Hearne Municipal Court. A reader with a county Precinct 2 ticket should call JP2 instead. The city clerk is at 306 W 3rd Street, 979-279-6677; JP2 is at 1104 S Market Street, 979-279-2301.
Read the court name on the citation before using either route. A call can clarify what to bring, but it does not replace a required appearance.
Bench Warrant vs Arrest Warrant
[PARAGRAPH - Research §11. Why the two are different instruments: what triggers each, who issues it, and how each is enforced. See arrest warrants for the companion detail.]
| Feature | Bench Warrant | Arrest Warrant |
|---|---|---|
| Trigger | Missed setting or court obligation | Sworn complaint and probable cause |
| Who issues it | Court that set the case | Appropriate magistrate or criminal court |
| Underlying case | Existing case or citation | New or charged offense |
| First contact | Clerk for the underlying case | Issuing clerk and counsel |
| Ask next | Appearance, plan, bond, or recall route | Charge, bond, and safe appearance route |
Robertson County Bench Warrants Cross Court Lines
Franklin is a useful example of the local split. Franklin Municipal Court handles city citations at 319 Bremond Street. JP3 is a county precinct court at 102 E Decherd Street. They are separate courts with separate clerks and payment accounts, even though both are in Franklin.
The county's Justice page lists JP1 in Calvert, JP2 in Hearne, JP3 in Franklin, and JP4 in Bremond. City process remains with the municipal court. Use the government name printed on the paper to pick the right first call.
Franklin's court page gives a general second- and fourth-Tuesday pattern, but readers should confirm whether their case can be handled at that setting.
How to Resolve a Robertson County Bench Warrant
Begin with the issuing clerk, not a generic sheriff search. Ask what the process is called and whether counsel can request a recall, arrange a new setting, or address a bond. A fine-only city or JP case may have a payment or plan route; an active criminal capias may need a lawyer and a court appearance.
- Confirm the court, case number, process type, balance, and next setting.
- Ask whether a lawyer should file a motion to recall or arrange an appearance.
- Get the court's instructions before going to a courthouse or jail; no universal walk-in schedule is published.
- Follow the approved payment, plan, bond, or new-setting route and request written proof.
Caution: Do not assume a warrant expired because it is old or absent online; ask the issuing court whether it remains open and what action is required.
Robertson County Bench Warrants Have No Surrender Window
The sheriff and jail pages do not publish a countywide surrender time, warrant counter, or bond window. The jail-information page links magistration material but does not give a universal release schedule. Call the court or sheriff first and ask where the person should report, what identification is needed, and whether counsel should arrange it.
Do not use the 24-hour non-emergency line as an assumption that a clerk is available to recall a court order. For questions about court process, contact the District Clerk, County Clerk, JP, or city clerk that owns the case.
Which Robertson County Court Issued It
Felony and district criminal cases go through the 82nd Judicial District Court and District Clerk. County-court matters use the County Clerk. A traffic or fine-only citation names one of the four JPs or a city municipal court. The issuing court, rather than the serving officer, controls the case record and recall.
The 82nd District Court page identifies the court serving Falls and Robertson Counties. Its criminal rules addendum took effect June 1, 2025, but it does not create a public warrant search. Use the county warrant search steps to route a record question, then confirm with the clerk.
The court's contact page and docket material are shown here as an orientation aid, not a live warrant result:
Robertson County Bench Proof Comes from Court
When a clerk confirms process, write down the issuing court, case or citation number, exact label, current balance, next setting, appearance rule, and the person or office that will provide written proof. Ask whether a payment alone recalls the warrant or whether the judge must enter an order.
Keep the receipt, new court setting, bond paperwork, or recall order. The JP handout gives an up-to-ten-business-day reporting estimate for qualifying matters, while DPS gives a separate up-to-seven-business-day processing estimate after a court reports an eligible FTA/FTP clearance.
